Terms of Service

1. Acceptance of Terms
By downloading, installing, or using Aria ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.
2. License Grant
Aria is released under a dual license model:
Personal/Non-Commercial Use (MIT License)
For personal, educational, or non-commercial use, Aria is licensed under the MIT License. You may use, copy, modify, merge, publish, and distribute the Software freely, subject to the conditions of the MIT License.
Commercial Use
For commercial use—including but not limited to use within a business, resale, bundling with commercial products, or any use that generates revenue—you must obtain a commercial license from 5060 Solutions. Contact sales@5060solutions.com for licensing options.
3. Definition of Commercial Use
Commercial use includes, but is not limited to:
- Using the Software for business operations or communications
- Deploying the Software in a for-profit organization
- Selling or distributing the Software as part of a commercial product
- Using the Software to provide paid services to others
- White-labeling or rebranding the Software for resale
- Integrating the Software into commercial products or platforms
4. SIP Services
Aria is a softphone client that connects to SIP servers. 5060 Solutions does not provide SIP service, phone numbers, or calling minutes. You are responsible for obtaining your own SIP service from a provider of your choice. Your use of any SIP service is governed by that provider's terms and conditions.
5. Call Recording Compliance
Aria includes call recording functionality. You are solely responsible for complying with all applicable laws regarding call recording in your jurisdiction. Many jurisdictions require consent from one or all parties before recording a conversation. 5060 Solutions is not responsible for any legal consequences arising from your use of the recording feature.
6. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
7. Limitation of Liability
To the maximum extent permitted by law, 5060 Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Software.
8. Emergency Services
ARIA IS NOT INTENDED FOR AND SHOULD NOT BE USED FOR EMERGENCY CALLS (E.G., 911/112/999).
VoIP services, including those accessed through Aria, may not support emergency calling or may not function correctly for emergency purposes. Location information may not be transmitted to emergency services. Always have an alternative means of contacting emergency services.
9. Security
While Aria supports TLS and SRTP encryption, the security of your communications ultimately depends on your SIP provider's infrastructure and configuration. We recommend enabling encryption features, but we cannot guarantee end-to-end security of your calls.
10. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Software after any changes constitutes acceptance of the new terms.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 5060 Solutions operates, without regard to its conflict of law provisions.
